Terms of Service

Effective: March 5, 2026

These terms govern your use of Dictis ("the Service"), a voice note-taking application operated by Mitja Eichhorn ("we", "our", "us"). By creating an account or using the Service, you agree to these terms.

1. Service Description

Dictis is a voice note-taking application that records audio, transcribes speech to text, and uses AI to generate summaries, key points, action items, and other structured data from your recordings. The Service is available as a mobile application for iOS and Android, and via the web.

2. Account Registration

You must create an account to use Dictis. You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration and keep it up to date.

3. Subscription Plans and Billing

Free Trial: New accounts receive a 30-day free trial with unlimited features. After the trial, your account transitions to the Free plan.
Free Plan: Limited to 5 notes per month with full AI processing.
Pro Plan ($9/month): Unlimited notes, priority processing, and all integrations.
Team Plan ($19/month): Everything in Pro, plus team sharing and collaboration features.

Paid subscriptions are billed monthly via Stripe. You can cancel at any time through the subscription management portal. Cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or to violate any laws.
Record conversations without the consent of all participants where required by law.
Upload content that infringes on intellectual property rights of others.
Attempt to reverse engineer, decompile, or disassemble the Service.
Use automated means to access the Service beyond the provided API with a valid API key.
Resell or redistribute the Service without our written permission.

5. Your Content

You retain all rights to your recordings, transcripts, and notes. We do not claim ownership of any content you create using Dictis. We access your content solely to provide and improve the Service (transcription, AI analysis, storage).

6. Intellectual Property

The Dictis application, including its design, code, and branding, is the intellectual property of Mitja Eichhorn. You may not copy, modify, or distribute any part of the Service without written permission.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for:

Inaccuracies in AI-generated transcriptions, summaries, or action items.
Data loss due to circumstances beyond our control.
Service interruptions or downtime.
Any indirect, incidental, or consequential damages.

Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

8. Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of significant changes via the app or email.

10. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
